High Risk Car Insurance in Tennessee
Reader’s Question:
When an insurance carrier ask for an SR-22 to be filed, what information regarding on why is it in Hendersonville, TN? Is this a way the insurance carrier finds out that you might be a high risk driver?
John
Hendersonville, TN
The SR-22 certificate in Tennessee is proof of future financial responsibility as required under Tennessee Code Annotated 55-12-114.An insurance carrier needs the information as to why the SR-22 policy is needed so they can inform the state of your compliance.
Tennessee Insurance carriers are aware of Tennessee Code and the reasons listed there by the state of why an SR-22 may be required by a person. Therefore insurance providers do not ask why to know if you are a high risk driver or not.
Insurance carriers in Hendersonville will determine if you are a high risk driver by your driving history and several other factors. For example if you are required to carry a SR-22 because of a DUI, the insurance carrier will find out about the DUI violation from your driving record anyway so answering the reason why you need the SR-22 is not giving them information they could not find out on their own.

Robert
Johnson City, TN
Because you are from Tennessee, this out of state traffic violation may or may not put points onto your Tennessee license.
Tennessee dropped out of the Drivers License Compact (DLC) in 1997 but the state still share tickets violations back to your home state and other states can still share moving violations to the Tennessee Department of Safety. You will have to contact this state agency to verify if the Virginia speeding ticket is on your driving record.
If the speeding ticket appears your Johnson City, Tennessee driving record, your car insurance rates could be affected depending on your insurance carrier’s rating system. You may contact your insurance company to find out about their rating system or contact your state’s insurance regulator.
Car Insurance Cancellation in Tennessee
Reader’s Question:
Is there a grace period in the state of Tennessee if your car insurance was canceled because of past due amount?
Harry
Murfreesboro, TN
While other types of insurance, health or life, may permit a grace period for your insurance policy, car insurance does not. In TN there are insurance laws in place that regulate how an insurance company must tell you of a cancellation because of non-payment, etc but not that there is any type of grace period that must be extended to a policyholder due to past due amount
If your car insurance policy cancelled because of non-payment you need to try to get your insurance policy reinstated or get insurance on your vehicle from a new insurance company or face penalties.
The Tennessee legislative branch has discussed getting harsher penalties in the books for operating a vehicle without insurance since there are so many uninsured motorists on the roadway. Make sure you dont get caught driving without insurance or let your insurance lapse for a very long time. If you do then you will have to face penalties and fines plus find it harder to get car insurance.

Reader’s Question:
My wife has a poor driving record and I am wondering if I can do a named motorist exclusion from car policy in Tennessee?
Dan
Nashville-Davidson, TN
Insurance company guidelines differ but you should be able to find an insurance provider in Tennessee that will permit you to exclude your wife from your auto insurance policy if you wish to. When buying, choose the option to not include that motorist on the insurance policy and choose the appropriate exclusion options to get an accurate insurance rate.
Make sure that if you did exclude your wife then none of the coverages under your auto insurance would extend to her in any way if she was to operate the vehicle(s) listed on your insurance policy and cause an accident. So even in an emergency situation she should not operate your vehicles.
Whether family or household or named-driver exclusions are allowed in Tennessee has gone to the courts on various occasions. On the court cases I have read about the courts have found that these types of exclusions in auto liability insurance policies do not violate TN law or public policy.
